Diana Zinser has been appointed as Co-Lead Counsel in Frasco et al. v. Flo Health, Inc., et al., a data privacy class action. Plaintiffs who used the popular ovulation- and period-tracking Flo App allege that its creator, Flo Health Inc., unlawfully divulged users’ personal health information to third-party advertisers and data analytics companies, including Facebook and Google, in violation of state and federal statutes and other laws. This personal health information included details about users’ sexual activity and whether they were trying to become pregnant. 

The litigation follows an FTC investigation and complaint alleging that Flo Health Inc. misled Flo App users about how their personal data was used. In its January 2021 settlement with the FTC, Flo Health Inc. agreed to inform users their personal health information had been divulged to third parties and to stop disclosing such information going forward. The case is pending in the Northern District of California before Judge James Donato.
